Anyone got experience of small claims/debt recovery agencies to recover money??
OK then, I'm just wondering which method tends to be most successful for recovery of an amount of money that is comprised part business, part personal. Is it the online small claims part of HMCC or selling the debt to a debt enforcement agency?

Reason being, is that a certain someone owes a not inconsiderable amount of money and I want to ensure it is recovered as quickly as possible. This person is cosnistently refusing to respond to text messages, calls or emails to try and resolve the issue amicably, even to the point of point blank refusing face to face contact.

Obviously using a debt enforcement company will result in the loss of a percentage, but at least they are a bit tougher than the courts aren't they, who will allow some pony payment of £1 a week or something. And that is something this person has hinted they would propose if it went to court.

What are the alternatives?? Filing for bankruptcy is pointless as he owns nothing and would result in an even smaller amount being recovered. I did wonder if there was the possibility of trying to push for a deception charge, in particular regarding the personal portion of the debt, as it was borrowed under false pretences. That at least would get the Police involved, who would hopefully be able to strong arm the f*cker a bit more!!!

Anyone got experience in this kind of situation? How did you get on? How long did it take? And is it better to just send some nasty lads round?? haha

Hi Ajay, i use to work in debt recovery for 4 years and not being big headed but was one of the top earners for recovering debts( our debts were people who got loans, mobile phones etc).. Do you have there details, ie: phone number, address etc??

Give me a pm and i can advise you the best ways hun:)

Adam deals with Debt recovery but you might wait a month for him to return any calls you make to him so act fast!

When i used to get money off the dodgy car dealers i used to do it myself thru small claims court. always worked for me mate. Remember to add statutory interest to the debt too !

Looks like the ball is rolling nicely people - cheers to you all who PM'd me info. Also cheers to other people owed money by this person, your assistance is greatly appreciated and new contact details have been forwarded to the relevant agencies. Having made some additional investigations, there really is no way out. Folding is not an option due to sole trader status meaning that debt liability cannot be passed, and attempting to do anything else to shirk payment while still operating (in any capacity) would constitute trading a liquidated operation which is a criminal offence under DTI regulations, carrying a severe sentence.

I I am not very much mistaken, I believe Greg Lynn, a pretty well known music journalist, recently reported on a very similar case - must call him, as I'm sure the "Roger Cook of Dance Music" would love to get his hands on this little one!!!

Ajay follow it through legally... or 'above board' and make sure this person's knee capped after it's all finished and you've got your money back :) Or, finger capped, which may leave him slightly more incapacitated considering the industry eh?
